Course Policies

Non-Liability.
Athivia College provides all information, access to the site, resources and
links on an as-is basis. This information is general in nature and not in any
way to be constituted as legal or professional advice. Specifically, Athivia
College provides no warranty regarding the accuracy or suitability of any
content provided on the website for any given task and is specifically not
responsible for any damages, direct or indirect, from its use.
2.
Continued
usage of the site. Athivia College will make an effort to ensure the site,
courses and links are continuously operational and free from error, however
Athivia College does not guarantee that these courses will be functioning
properly or at all and will not be responsible for any failure by its own or by
external forces resulting in interruptions in the site.

resolved in the Province of Manitoba.

the validity or enforceability in that jurisdiction of any other
provision of this agreement; or
b. the validity or enforceability in other

This Master Privacy Policy (“Privacy Policy”) explains the collection,
use, and disclosure of “personal information” Athivia College, a Manitoba Corporation, with its principal
place of business at 2-B 136 11th Street, Brandon, MB Canada through

In addition, additional or
supplemental Privacy Policy terms (“Supplemental Privacy Policy Terms”) may
apply to a particular Website or service provided thereon. All such
Supplemental Privacy Policy Terms will be accessible for you to read either
within, or through your use of, that Website or service.
This Privacy Policy also explains our
commitment to you with respect to our use and disclosure of non personal
browsing and site usage data that Athivia College collects as the provider of
the Websites. That commitment is contained in a “Data Usage Policy,” below.

Athivia College is committed to

relevant to your interests. Athivia College does not, however, sell our mailing

Personal Information Athivia College Collects
We may collect personal information
at several places on the Websites, including without limitation:

courses

email to us or signing up to receive a newsletter or our events listing;

What Athivia College does with Personal Information
Course Records. We use the personal information
you provide to us as part of your selection of one of our courses to provide
you a unique, traceable student experience. This record provides us with
retained data reflecting activities and resources accessed, performance of
graded testing materials, etc.
Certification. When you have opted to purchase access to one of our certification
evaluations, your unique student data will be used to confirm your satisfactory
completion of the evaluation provided. We will release confirmation of this
completion to any third party you designate.
Emails and Newsletters. We use the personal information you
provide to us when you send us emails or sign up to receive our newsletter or
events listing in order to respond to your request — for example, to reply to
your email or to send you communications about news and events related to
Athivia College.
When you subscribe to our newsletter,
events list or one of our email discussion lists, your name and email address
is sent to and stored our servers. Personal information submitted as part of
our email discussion lists is used for the purpose of managing the discussion
lists. Your name and email address will typically be visible to other list
participants when you correspond on the list and to the general public in the
discussion archives. All emails sent to the discussions list are publicly
archived.
Advertising Communications and Links.
Athivia College may include, where it feels appropriate, advertising
communications and web links to advertisers related to course content. The
pages linked to on third party sites will not be subject to this policy: users
should check the information usage policies of the respective destinations for
more information.
Athivia
College may, from time to time, send students who have registered for courses
updates regarding new course resources or new courses which may or may not
include advertising links. Students will always be provided an option to
opt-out of further ongoing communications from Athivia College.
Donations. When you donate money to us or
purchase merchandise via our support page, your personal information will be
handled in one of two ways, depending on which option you choose.
1.
If you purchase a t-shirt or other merchandise from Athivia College, we
will use your personal information for the purpose of sending you the items you
purchased.
2.
You may donate money to Athivia College directly or through PayPal or other
related sites. When you use this website and service to donate to Athivia
College, your personal information is sent to, handled by and stored by those
websites in accordance with their respective privacy policies and terms of use.
You should read and understand the privacy policy and terms of use of any
website you use to donate to Athivia College. When you donate money to Athivia
College directly, we use your personal information to process your donation.
Regardless of the method by which you
donate to Athivia College or purchase a t-shirt or other merchandise, we
additionally use the personal information you provide for the purpose of
contacting you about upcoming news and events relevant to Athivia College. When
we contact you for the first time after your donation, we will use reasonable
means to give you the option to choose not to be contacted in this manner
again.
Athivia College Website. When you join our network you
provide personal information to create your account and establish a password and
profile, and to create a student ID. We use that personal information to
establish and maintain your accounts, provide you with the features we provide
for account holders, and for the purpose of contacting you about upcoming news
and events relevant to Athivia College.
By joining the Athivia College
network, you are also given a public profile page where you can voluntarily
post personal information for public viewing. The information you publish on
your public profile page, including your personal information, may be used by
anyone who views that information for any lawful purpose.
Participating in Our Community:
Registered Users. When you register to obtain a user account on any of the Websites
(any such person, a “Registered User”), you may be asked to provide personal
information to create your account and establish a password and profile. If you
voluntarily provide your real name in connection with any content you submit to
any Website, your name may be associated with the content you contributed (such
as when you edit a Wiki page). We will also use that personal information to
establish and maintain your membership and provide you with the features we
provide for Registered Users, and for the purpose of contacting you about
upcoming news and events relevant to Athivia College.
Any other personal information that
we may collect which is not described specifically in this Privacy Policy will
only be collected and used in accordance with the Principles.
Disclosures of Personal Information
In general, it is not Athivia
College’ practice to disclose personal information to third parties. We may
share personal information in two instances:
First, Athivia College may share
personal information with our contractors and service providers in order to
maintain, enhance, or add to the functionality of the Websites or the Athivia
College service.
Second, we may disclose your personal
information to third parties in a good faith belief that such disclosure is
reasonably necessary to (a) take action regarding suspected illegal activities;
(b) enforce or apply our Terms of Use and Privacy Policy; (c) comply with legal

If Athivia College is required to

event, unless prohibited by law or Athivia College is otherwise advised not to

Security of Personal Information Collected via the Websites;
Athivia College has implemented reasonable
measures to protect against unauthorized access to and unlawful interception or
processing of personal information that Athivia College stores and controls.
However, no website can fully eliminate security risks. Third parties may
circumvent our security measures to unlawfully intercept or access
transmissions or private communications. We will post a reasonably prominent

Data Usage Policy: Browsing and Site Usage Information
Our Data Usage Policy covers how we

server logs, including when you log into a website using your Athivia College
student ID.
Browsing Information We Collect. When you use the Websites, our servers
(which may be hosted by a third party service provider) may collect information
indirectly and automatically (through, for example, the use of your “IP
address”) about your activities while visiting the Websites and information
about the browser you are using. In addition, whenever you use your Athivia
College student id to log into a website, our servers (which, again, may be
hosted by a third party service provider) keep a log of the websites you visit
and when you visit them.
No Selling or Sharing. Except in the unique situations
identified in this Privacy Policy, Athivia College does not sell or otherwise
voluntarily provide the non personal browsing information we collect about you
or your website usage to third parties.
Notice. If Athivia College is required to
provide a third party with your non personal browsing information or to log in
on behalf of an user (whether by subpoena or otherwise), then Athivia College
will use reasonable means to notify you promptly of that event, unless Athivia
College is prohibited by law from doing so or is otherwise advised not to
notify you on the advice of legal counsel.
Any other non-personal information
that we collect which is not described specifically in this Privacy Policy will
only be collected and used in accordance with the Principles.
Athivia College may transfer some or
all of your personal and/or non personal browsing information to a third party
as a result of a reorganization, spin-off or similar transaction. Upon such transfer,
the acquirer’s privacy policy will apply. In such event, Athivia College will
use reasonable efforts to notify you and to ensure that at the time of the
transaction the acquirer’s privacy policy complies with the Principles.
The Websites are not directed at
children under the age of 13. Consistent with the federal Children’s Online
Privacy Protection Act of 1998 (COPPA), we will never knowingly request
personal information from anyone under the age of 13 without requiring parental
consent. Our terms of use specifically prohibit anyone using our

Athivia College through the Websites represents that they are 13 years of age

Athivia College operates in Manitoba,
